Agreement to Terms
By accessing or using GardenSpace services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
Service Description
GardenSpace provides a lead generation and survey booking service for modular garden building companies in Ireland. We:
- Identify suitable properties using satellite imagery and data analysis
- Generate and send personalized direct mail to property owners
- Facilitate booking of on-site surveys with partner companies
- Operate on an exclusive, territory-based partnership model
Partnership Terms
Territory Exclusivity: Each partner is granted exclusive rights to a defined territory (typically one county). We will not work with competing garden building companies in your assigned territory during the term of our agreement.
Pricing: Partners pay only for completed surveys. Pricing is agreed upon during the partnership negotiation and documented in a separate partnership agreement.
Quality Standards: Partners must maintain professional standards in all customer interactions and honor all booked survey appointments.
Intellectual Property
The GardenSpace website, technology, processes, and materials are owned by GardenSpace Ireland and are protected by Irish and international copyright, trademark, and other intellectual property laws.
Limitation of Liability
GardenSpace provides lead generation services but does not guarantee any specific number of leads or conversion rates. We are not responsible for:
- The outcome of surveys or customer interactions
- Business decisions made by partner companies
- Changes in market conditions or homeowner demand
- Technical issues beyond our reasonable control
Termination
Either party may terminate the partnership agreement with written notice as specified in the partnership contract. Upon termination:
- All outstanding invoices become immediately due
- Territory exclusivity ends
- Both parties must fulfill obligations for any pending booked surveys
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the Irish courts.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
